Terms and Conditions of Purchase

The general conditions for the use of the electric tuk-tuk service offered by the company TUK TUK TRIPS S.L. are set out below. Minor users must be accompanied by their father/mother or guardian, and the service is only suitable for children from two (2) years of age.

Itineraries cannot be modified, shortened, or simplified at the client’s request, nor can they be carried out without returning to the starting point. It is also not possible to modify the starting point or hire only part of the tour for a partial price. Any improper use of the service that could be considered as public passenger transport in tuk-tuks, for the simple purpose of moving from one place to another, is prohibited. Pets are not allowed.

The guides/drivers who operate the tuk-tuks are drivers and assistants to tour group guides; it is emphasized that they are not, nor do they intend to be, official tour guides.

Purchase Conditions

  • The price and duration of the service are those reflected in the website rates at the time of booking and are established based on the Current General Rate (regarding services, taxes, and fees).
  • The mere reservation of the service shall not be considered as granting the right to use it. The service will be considered contracted once the client has made the payment via credit card.
  • The Client agrees to be ready for the start of the service at the scheduled date and time and at the pickup point. In the event of a delay, the contracted activity will be reduced according to the time lost, which may result in a change to the fixed route and duration of the service. The activity will be considered canceled if the delay exceeds 15 minutes, and in such a case, no refund of the amount paid will be issued.

  • The client agrees to pay the amount corresponding to any fines or sanctions derived from any violation of current legislation incurred due to misuse or bad behavior during the service, as well as the corresponding surcharges for late payment by the Client and any judicial or extrajudicial expenses that TUK TUK TRIPS S.L. may have incurred as a result of the above.

Reservation Cancellation Policy

  • If the cancellation of the contracted service is made with more than 24 hours’ notice, 100% of the amount paid will be refunded. Cancellations are not accepted with less than 24 hours’ notice. If the reservation is canceled without notice, TUK TUK TRIPS S.L. will not issue any refund.
  • In the event that weather conditions or other exceptional circumstances (street closures, demonstrations, public gatherings, etc.) completely prevent the service from being carried out, the amount paid will not be refunded.
  • In the event of an error when booking the number of tuk-tuks on the website, and if this is not realized until the start time of the tour, TUK TUK TRIPS S.L. will not issue any refund, as that availability will not have had the possibility of being booked by another client.
  • No more than four people are allowed per tuk-tuk; therefore, if more than four people arrive having booked a single tuk-tuk, the reservation cannot be canceled.

  • In the event of changes to the itinerary due to closed streets or demonstrations on the day of the tour, the amount paid will not be refunded.

Tuk-Tuk User Guide

Service contractors are informed that the tuk-tuk guide/driver reserves the right not to start or, if applicable, to terminate the activity if any of the actions detailed below are breached or contravened:

  • The client agrees to make responsible use of the space occupied in the tuk-tuk, as well as all other components, and to comply with the rules of the Highway Code.
  • It is prohibited to change the seat assigned to each participant at the start of the activity, as well as to get off the tuk-tuk for the duration of the activity, unless otherwise instructed by the guide/driver.
  • It is prohibited to stand up or perform any movement likely to alter the normal operation of the tuk-tuk and/or cause discomfort or damage to other occupants of the tuk-tuk or other road users. It is therefore strictly forbidden to stick arms, legs, and/or objects out of the tuk-tuk.
  • Occupants of the tuk-tuk during the activity are obliged to be respectful toward other users and pedestrians, avoiding at all times any offenses or insults, as well as excessive shouting or yelling, maintaining a reasonable and appropriate noise level at all times.
  • It is the obligation of the occupants to care for and respect the furniture on board the tuk-tuk.
  • Participants are obliged, before and throughout the tour, to wear clothing appropriate for the type of activity. Going shirtless is prohibited.
  • It is prohibited to carry out any action likely to distract the guide/driver, as well as to attempt to take control of the tuk-tuk.
  • It is prohibited to bring alcoholic beverages on board the tuk-tuk. Non-alcoholic beverages and certain foods (snacks, etc.) are permitted, provided they are not packaged in glass, tin, or ceramic containers.
  • Smoking on board the tuk-tuk is prohibited.

Please note that the above list is not exhaustive and may include any unusual action contrary to what is normally required of other citizens.

Our Recommendations

  • If the activity is to take place during the summer months, to avoid heatstroke and other adverse effects caused by the temperature, participants are recommended to bring a bottle of water in a plastic container and use sunscreen.
  • The tuk-tuks do not have space to store suitcases, only small bags or backpacks; therefore, it is recommended to check the volume of your belongings before boarding the tuk-tuk.

Civil Liability, Waivers

As I am over 18 years of age and therefore an adult, and participation in the activity carried out by contracting the service is entirely voluntary, I am aware that I am solely responsible for my behavior/actions for the duration of my participation in the activity organized with the tuk-tuk by TUK TUK TRIPS S.L., as well as responsible for the behavior/actions of the minors in my charge.

  • I am aware of and responsible for the risks and exempt TUK TUK TRIPS S.L. from any damage and/or physical injury that I or the minors in my charge may suffer during the activity as a result of any action or behavior that contravenes the provisions of the general conditions of service.
  • I am aware of and responsible for the risks and exempt the aforementioned contracting entity from any damage and/or physical injury that I or minors in my charge may cause to third parties outside the activity during the course of it, as a result of any action that contravenes the provisions of the general conditions of service.
  • I am aware of and take responsibility for any reports that Law Enforcement Agents may file as a result of my actions or those of the minors in my charge on board the tuk-tuk or during the performance of the contracted service.
  • I exempt TUK TUK TRIPS S.L. from liability if, due to circumstances beyond its control that prevent the scheduled route (e.g., traffic cuts), it has to pass through unscheduled locations or reduce its duration without prior notice to participants.
  • I exempt TUK TUK TRIPS S.L. from liability for any theft that I may suffer from a third party during the tour.
  • I exempt TUK TUK TRIPS S.L. from liability in the event that the guide/driver is forced to reduce or perform a shorter journey than contracted due to circumstances beyond their control, such as unpunctuality or bad behavior of all/some of the passengers.
  • I am aware of and take responsibility for any object, personal or otherwise (mobile phones, cameras, video cameras, etc.), falling from the tuk-tuk, whether the tuk-tuk is in motion or stopped/parked.
  • I exempt TUK TUK TRIPS S.L. from liability for any breakage or damage that an object, personal or otherwise (mobile phones, cameras, video cameras, etc.), may suffer as a result of falling from the tuk-tuk after having been handed to company personnel for taking photographs, videos, etc.
  • I am aware of and undertake to follow, and ensure that the minors in my charge follow, the instructions of the company personnel regarding the position to be occupied in the tuk-tuk, in order to maintain order and the smooth running of the activity, especially when various unknown groups are participating.
  • I am aware of and take responsibility for any damages or injuries, whether my own or those of third-party participants/persons outside the activity, that I or the minors in my charge may cause as a result of violating the prohibition on changing seats/getting off the tuk-tuk for the duration of the activity.
  • TUK TUK TRIPS S.L. shall not be held responsible for damages caused by third parties to passengers.

Express Acceptance

  • I have been informed and, therefore, authorize and accept that the company TUK TUK TRIPS S.L. may use and/or publish my image and those of the minors in my charge for advertising or marketing purposes. In case of disagreement with this clause, the personnel in charge of the activity must be informed, and they will record said refusal in writing (a document that must be signed by both contracting parties).
  • I have been informed and, therefore, authorize and accept that the company TUK TUK TRIPS S.L. uses cameras in the tuk-tuk for security and internal control purposes. The images taken by these cameras will only be used for internal statistical control by TUK TUK TRIPS S.L. and will be deleted after 30 days (as established by law). In case of disagreement with this clause, the personnel in charge of the activity must be informed before contracting the service.
  • That, in the event of any doubt or misunderstanding regarding the terms of the contract and in the absence of proof to the contrary, the parties shall adhere exclusively to what is set out in writing.
  • That, in the event of cancellation and/or a reduction in the total duration of the activity due to causes beyond the service provider’s control, no refund shall be made of any amount paid on account.

Computer processing of personal data

The Customer authorises the automated processing of the personal data collected in this contract, which is necessary for the provision of the agreed service, as well as for the offering and contracting of other products and other company services. The Customer is hereby informed of the right to access, rectify and, where applicable, cancel their personal data by email  info@tuk-tuktrips.com

Likewise, the Customer gives their consent for TUK TUK TRIPS S.L. to transfer their data to group companies, its franchisees, or other companies with which TUK TUK TRIPS S.L. enters into collaboration agreements for the better provision of this service, whether based in Spain or abroad, in compliance with Spanish legislation on the protection of personal data.

Applicable legislation and jurisdiction

This contract shall be governed by and interpreted in accordance with Spanish law. Any matters arising from this contract between TUK TUK TRIPS S.L. and the Customer shall fall under the jurisdiction of the Spanish courts and tribunals corresponding to the city where the contract was signed, to which both parties submit.

Confirmation

From the confirmation of the booking and therefore the payment for the service, the customer expressly accepts these Terms and Conditions of Purchase in full. If a person registers another person/people, or is responsible for minors, they accept these Terms and Conditions of Purchase in full on their behalf.
